The present privacy policy (“the Privacy Policy”) is an integral part of our General Terms of Business. It describes how personal data are collected from you (“the Data Subject” or “the Buyer”) and how we process them when you use our website www.bibusbaltics.eu or mobile application (“the Site”). By using the Site, you consent to the collection, use, processing and sharing of your information as described in this Privacy Policy.

“BIBUS Baltics” SIA is a data controller (hereinafter referred to as “the Controller”,  or, as appropriate, “we”, “us” or “our”) who respects the privacy of every individual who visits the Site, therefore we ensure the processing of personal data is executed according to the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as “GDPR”).

1. General

All terms used in this Privacy Policy and not defined otherwise herein shall have the meaning ascribed to them in the GDPR.

We are committed to recognising and respecting your privacy rights by keeping you informed and ensuring that processing and protection of your personal data is in compliance with the GDPR and other applicable data protection laws and regulations (“Data Protection Laws”).

We do not verify your identity therefore we assume that the person who has registered as a representative of a Buyer or is using the Site is you or someone authorised to share with us your personal data on your behalf.

2. When we may collect your personal data?

We may collect your data through the Site when you:

•            Register as a representative of a Buyer;

•            Subscribe for our newsletter;

•            Ask for an advice or communicate with a Product Manager;

•            Make a purchase or use our services;

•            Contact us through the Site, by mail or telephone or visit us in our office;

•            Give us your feedback;

•            Conclude a cooperation agreement;

•            Give us your personal data in some other way or for some other reason.

3. What categories of personal data we may collect?

We may collect and process some or all of the following types of personal data you make available to us:

•            Name;

•            E-mail address;

•            Billing address and shipping address;

•            Phone number;

•            Interests, represented industry;

•            User name;

•            Password;

•            IP address (via server logs);

•            Financial and payment details;

•            Other registration information.

In addition to the information, you have submitted to us, BIBUS Baltics may automatically collect and process other personal data about you which may include:

•            Information collected through cookies and other tracking technologies including, but not limited to, your IP address and domain name, your browser version and operating system, traffic data, location data, web logs and other communication data and the resources that you access;

•            Device registration data (for example, the type of the mobile device you use, its unique device or advertising ID, the IP address, the type of the operating system and browser that you use);

•            Device settings (for example, your language preference);

•            Mobile carrier;

•            Information about how you use the Site (for example, how many times you use the Site monthly);

•            Requested and referring URLs;

•            Location data collected through your device (including, for example, precise location data such as GPS and WiFi information).

4.           What is our Cooky policy?

We use both session cookies and persistent cookies on the Site. Cookies do not contain any information that personally identifies you, but personal information that we store about you may be linked to the information stored in and obtained from cookies.

The cookies used on the Site include:

•            Necessary cookies - enable basic functions and are strictly necessary for access and navigation and proper functioning of the Site. Without them the site won’t be able to work properly, for example, you will not be able to register and make purchase.

•            Statistic – Statistic cookies collect information anonymously. This information helps us to understand how our visitors use our Site, for example, what pages you visit and how long you spend on them, which allows us to improve the user experience basing on trustable data.

•            External media – In order to be able to display content from video platforms and social media platforms, cookies are set by these external media.

 

Third party cookies – data sharing

When you use the Site, you may also be sent third party cookies who may combine received data with other information that you’ve provided to them or that they’ve collected from your use of their services. Our analytical service providers and advertisers may send you Statistic, External media and marketing cookies.

Third party features and links

The Site may include links to other outside third-party services and sites, and we do not control or attempt to control the privacy policies of these third parties. When you access another website or purchase or accept products or services or otherwise engage in transactions with third parties (whether within or outside of the Site), the use of any information that you may provide in connection therewith will be governed by the privacy policy of the applicable third party, and not this Privacy Policy.

•            Blocking cookies - most browsers allow you to refuse to accept cookies. However, blocking all cookies will have a negative impact upon the usability of many websites. If you block all cookies, you may not be able to use certain features on the website, for example to use search functions on make a purchase.

•            Deleting cookies or changing status of cookies. You can also delete cookies already stored on your computer or reset the cookie preferences through your browser - obviously, doing this may have an impact on the usability of many websites.

•            Select your preferences - alternatively, you may click the “cookie settings” on the Site, chose “show details” and give your consent to cookies you prefer. Your preferences will apply to this website only. Please note that some processing of your personal data may not require your consent, but you have a right to object to such processing. You can change your preferences at any time by returning to this Site.

5.           What is the legal basis for processing your personal data?

In this Section, we describe the purposes for which we use personal information that we collect when you use the Site.

Improving the Site. We may use the data you provide or that are collected through the Site to operate the Site and improve your user experience, to provide you with customer support and to contact you from time to time to provide you with important information and notices relating to our products, and to carry out obligations arising from any agreements between you and us. The legal basis of such processing is the performance of a contract or our legitimate interests to enable us to sell our products and to improve the Site by adjusting it to your needs and preferences.

Providing support and communicating with you. Every time you ask for an expert’s advice or give us feedback, request an assistance to return products or solve a problem, or initiate the communication for any other purpose we may process your personal data to provide you with the required support. The legal basis for this processing may be either the performance of contract or your consent which will be considered as given by you upon initiating the communication.

Profile set-up and purchases. When you create a profile of a Buyer or make a purchase through the Site, you provide us with your personal information that may be processed for the purposes of providing you with our services or delivering the products purchased, or keeping proper records of those transactions. The legal basis for this processing is the performance of a contract between you and us and/or taking steps, at your request, to enter into such contract and our legitimate interests in proper administration of our Site and business.

Newsletters, marketing and promotional materials. When you subscribe to our newsletter, you provide us with your personal information that may be processed for marketing purposes, for example, to inform you about the recently added products, upcoming events, as well as to provide you with updates, offers and promotional materials. The legal basis for this processing is your consent. To unsubscribe from receiving our marketing communications to your e-mail, please use “unsubscribe” link which you’ll find in the end of every received e-mail or notify us via email info@bibusbaltics.eu that you are no longer interested to receive newsletters.

Analytics Services. We may use third-party analytics companies for data collection, reporting, ad response measurement, website and mobile application analytics, etc. to help us understand and analyse how our clients use our Site and to assist with delivery of relevant marketing messages and advertisements.

We may use an analytics service provided by Google or some other third-party analytics service to collect information about your use of the Site. These analytics services may collect information about the content you view, information about your system and your geographic location. The information generated by the analytics services about your use of our Site will be transmitted to and stored by the analytics services.

We encourage you to review your device settings to ensure they are consistent with your preferences, including as regards the collection and use of the information. You may be able to preclude further collection of certain data or sharing of your location details by adjusting the relevant settings in your device.

The legal basis for processing of your data by analytics services is your consent (in most cases) and our legitimate interests to provide you with user experience customized to your interests.

6. With whom your personal data may be shared?

We may share the information provided by you or collected by us with third parties inside or outside the EU or EEA territory only for specific purposes. We may be required to share your data with the following categories of the recipients of data:

•            BIBUS Holding AG group companies. Our goal is to support our customers with superior quality products and share the experience of our international experts who may be involved in execution of the project and thus gain access to your data.

•            Cooperation partners. The entities that are parties to the cooperation agreements establishing mutual obligations with the purpose of ensuring services to the customers, for example, credit card or payment processing providers (banks, PayPal, Shopify or other financial service providers), delivery services (warehouse, courier and mail services, etc.), service quality control (incl. external quality auditors, survey organisers, etc.), management needs (cooperation partners for management of organizational, financial and accounting processes, incl. auditors), cooperation partners providing IT support (incl. data storage and server rent), marketing service providers and legal service providers (incl., debt collection agencies, credit rating agencies, etc.). These service providers will only have access to the information required for them to perform these limited functions on our behalf.

•            Advertisers. We may share your information with advertisers, third-party advertising networks, e-mail marketing and analytics companies who may use it to deliver to you interest-based advertisements on the Site or third-party websites.

•            Social Media and Sharing. BIBUS Blatics may use social media for advertising it’s products, trademarks, the Site etc.

•            Supervisory authorities. To the extent permitted by law, we will disclose your information to the government authorities, if required to do so by law, if we, at our sole discretion, believe that disclosure is necessary to prevent fraud or infringements on the property rights or other rights held by us, other users, third parties or the general public, or if we believe that you have abused the Site by using it to attack any other system or to gain unauthorized access thereto, to engage in spamming or other activities violating the applicable laws or our General Terms of Business.

7.           Will your personal data be transferred internationally?

Please note that your personal data may be transferred outside the EU or EEA territory to the categories of the recipients of data stated above. If you do not want your data to be transferred or processed or stored outside the EU or EEA territory, you should not use the Site.

Each service provider with whom BIBUS Baltics may share information (as described in Clause 6) is vetted and bound by contractual obligations that are at least equivalent to the provisions of this Privacy Policy to ensure that our partners provide an adequate level of protection to your personal data.

8.           How we store your personal data?

We only store your personal data for as long as necessary for the purpose the data were collected for or for any other permitted and related purpose.

This means that the personal data collected based on your consent will be deleted if you withdraw your consent. For example: data processed for the purpose of sending you our newsletter will be deleted after you unsubscribe.

The personal data we process for the performance of the contract with you will be deleted when the contract has been fulfilled and all obligations under the contract have been discharged. The personal data related to Buyer’s profile will be retained until we delete the Profile upon your request or by our own consent. Meanwhile, the personal data related to purchases and their shipment will be deleted on eleventh year after their delivery.

Analytical data collected from your device will be deleted upon your request or when no longer needed for analysis.

We provide industry-standard physical, electronic and procedural safeguards to protect your personal data that we process and retain. For example, we take reasonable measures to limit access to those data to authorised employees and to provide our contractors only with the information that they need to know in order to fulfil their obligations. How long we will retain your personal data will depend on our business needs and legal requirements.

9.           What rights do you have as a Data Subject?

If certain requirements are fulfilled, you have:

•            the right to be informed and to access your personal data which means that you have the right to obtain from us information as to whether we process your personal data and, if we do, to gain access to your Personal data;

•            the right to rectification and erasure which means you can request rectification of any erroneous or false information or erasure of your personal data. You may request deletion of your data by contacting us via e-mail: info@bibusbaltics.eu;

•            the right to object to data processing and to restrict it;

•            the right to data portability which means you have the right to receive some of the personal data you provided to us in a structured, commonly used and machine–readable format and to transmit them to another data controller;

To exercise your rights, please contact us via e-mail: info@bibusbaltics.eu. Please include the name and e-mail you provided through the Site upon registration. We may ask you to provide additional information to verify your identity or your e-mail account.

Our activities in the field of personal data protection are supervised by the Data State Inspectorate Republic of Latvia www.dvi.gov.lv/en , but before you turn to them for advice or a complaint, please contact us to resolve any misunderstandings as soon as possible.

Note that you do not need to contact the Data Protecting Officer to exercise the right to stop receiving marketing communication from us. You can opt out of receiving such communications directly from the newsletter by pressing “Unsubscribe”.

10. The Privacy of Children

The Site is not intended for persons younger than 18 years. We do not knowingly collect or share personal information obtained from children. If a parent or guardian becomes aware that their child has provided us with some information, please contact us via e-mail: info@bibusbaltics.eu 

If you are a resident of the country where national laws contain personal data processing requirements stricter than those included in this Privacy Policy or the GDPR, please inform us about the need to apply specific safe-guarding measures or restrictions to processing of your personal data via e-mail to info@bibusbaltics.eu and quote the legal requirements applicable to you.

11.         Updates to this Privacy Policy

BIBUS Baltics reserves the right to amend these terms at any time and at its sole discretion. If we amend our Privacy Policy terms, we will post the amendment on the Site and update the “Last Updated Date”. If you are a registered Buyer, we will send you a prior notice of the amendment.

By continuing to access the Site after we have posted an amendment on the Site and/or have sent you a notice of the amendment, you agree to be bound by the Privacy Policy as amended. If the amended terms are inacceptable to you, your only recourse shall be to cease using the Site.
